Kan. Stat. Ann. § 65-6004, Physician authorized to disclose to certain persons information about patient who has infectious disease
This will open in a new window
Authorizes physicians that are performing a procedure on a patient to disclose that patient’s infectious disease status to EMS, law enforcement, corrections officers, or other health care providers if such persons have or will have exposure to the patient’s body fluids. Prohibits persons that receive such information from disclosing it unless necessary to treat the patient. Permits physicians to notify their patient’s spouse or partner about the patient’s HIV/AIDs status if they believe the spouse or partner is unaware of such status and may have been exposed. Clarifies that this section does not establish a duty for physicians to warn persons of their possible HIV exposure. Grants immunity to physicians for liability arising out of their decision to disclose or not disclose information.
