Kan. Stat. Ann. § 65-5602, Privilege of patient of treatment facility to prevent disclosure of treatment and of confidential communications

Grants patients receiving treatment in a facility a privilege to prevent facility personnel from disclosing information regarding their substance use disorder or mental health treatment as well as the fact that they have or are receiving treatment at the facility. Extends the privilege to include anyone who participates in individual, family, or group therapy sessions. Authorizes the individual, their guardian, conservator, or, if the patient is dead, their personal representative to claim the privilege. Requires treatment providers to claim the privilege unless the individual waives the privilege in writing or there is an exception to the privilege as stated in K.S.A. § 65-5603. Allows confidential communications to extend to all persons who participate in the patient’s treatment and diagnosis, persons present to help the patient during a consultation, examination, or interview, family members, and anyone the patient thinks should have the communication in order to help their diagnosis or treatment.
