Denial of Examination and Copying
Permits hospitals to deny a patient access to their health care information if the knowledge would imminently threaten the life or safety of the patient or another individual, the information could allow the patient to identify an individual who provided the information in confidence, the information was created for peer review, quality assurance, administrative, or litigation purposes, or when the law otherwise prohibits access. Requires hospitals to notify patients of the denial and, if possible, permit them to access portions of the information that do not generate the aforementioned concerns. Permits patients to designate a health care provider to access their information if the hospital denies patient access because the knowledge would imminently threaten the life or safety of the patient or another individual.
