Licensed physician assistants may report the name(s) of a patient’s spouse, sex partner, or person with whom the patient has shared hypodermic needles to the department of health services if the patient is HIV positive and refuses to notify these persons of their need to receive an HIV test. Physician assistants must ask the patient to notify their partners before reporting the names to the department of health services.
 
Licensed physician assistants that believe a patient has exposed a health care or public safety employee to HIV may inform the employee of their exposure so long as the physician assistant first asks the patient to make the notification and the patient refuses. Physician assistants may not identify the patient when informing an employee of their exposure.
 
Arizona clarifies that this section does not require physician assistants to report HIV information nor does the section expose a physician assistant to liability for disclosing or choosing not to disclose the information.
