Failure to report an adverse event; Penalties

The California State Department of Health may assess a penalty on any health facility (defined as a hospital, community health center or nursing facility) that fails to report an instance of an adverse event.  The penalty is a maximum fine of $100 per day not reported after the initial five day or 24 hour reporting period.  The health facility may dispute the failure to file within ten days.
