“Final proposed action; notice to licentiate; documents to inspect and copy; confidentiality; disclosure”

 

The administrator of a peer review body or chief of staff of a medical group is required to file a report with the appropriate agency within 15 days after the peer review group has made a final decision on a physician’s behavior with regard to the following actions:

  1. Incompetence or gross deviation from the standard of care;
  2. The use of drugs or excessive alcohol abuse;
  3. Repeated acts of excessive prescribing controlled substances;
  4. Sexual misconduct with one or more patients during treatment;

The law allows the agency to be able to inspect and copy relevant documents, charts, opinions, or medical records.  The report must remain confidential in accordance with California law.
