Confidentiality of records - 35 Pa. Stat. Ann. §10225.306

Information contained in reports, records of investigation, client assessment and service plans relating to abuse or neglect of service recipients over age 60 in any of the following facilities is confidential:

  •         Domiciliary care home;
  •         Home health care agency;
  •         Long-term care nursing facility;
  •         Older adult daily living center; or
  •         A personal care home.

Such information may only be disclosed in the following circumstances:

  •         To a court of competent jurisdiction
  •         Pursuant to a court order;
  •         To law enforcement officials if an investigation results in a report of criminal conduct;
  •         To appropriate service providers in arranging specific services;
  •         To a subject of a report upon written request, except for information that would identify the person who made the report or who cooperated in a subsequent investigation;
  •         To appropriate department staff, if the information is relevant to an appeal in which the department is involved; and
  •         To appropriate department staff for the purpose of monitoring agency performance.
