Confidentiality of and access to confidential reports - 35 Pa. Stat. Ann. §10210.505

Information contained in reports of abuse that are made to local protective service agencies, the department of public welfare and law enforcement agencies may be disclosed under the following circumstances:

  • To a court of competent jurisdiction under a court order;
  • To law enforcement officials if an investigation results in a report of criminal conduct;
  • To appropriate service providers in arranging specific services;
  • To a subject of a report upon written request, except for information that would identify the person who made the report or who cooperated in a subsequent investigation;
  • To appropriate department staff, if the information is relevant to an appeal in which the department is involved; and
  • To appropriate department staff for the purpose of monitoring agency performance.
