“Availability of Reports; Disclosure of Information”
 
Upon written request by any person, the Department shall provide the following information about a pending investigation into a report of suspected patient or resident abuse, neglect, mistreatment or misappropriation of property:the date on which Department staff visited the facility to conduct the investigation;the estimated date on which the Department expects to complete its investigation and issue its written report; andinformation about any actions taken by the Department or by the facilityto protect and ensure the health and safety of patients or residents.
Any oral or written reports of suspected patient or resident abuse, neglect, mistreatment or misappropriation of patient or resident property, which is made to the Department, remains confidential. These reports may be disclosed if the patient in question, his/her legal representative, the appropriate professional board of registration or a social worker assigned to the patient's or resident's case, provide a written request approvedby the commissioner.
