A health care facility, with the exception of home health agencies, hospice agencies, intermediate care facilities for the mentally retarded and birth centers, must retain medical records for 7 years after the date of discharge.  X-ray films or reproduction o films must be kept for 5 years after patient discharge. In the case of a minor, records must be retained 7 years or until the patient turns 21 years old, whichever is longer.
