When Authorization Required for Disclosure of Non-Public Personal Health Information
An insurer is not allowed to disclose a consumer's nonpublic health information unless (a) the insurer obtains the consumer's authorization to disclose, or (b) the disclosure is otherwise authorized by law.
However, this regulation does not prohibit disclosure of a consumer's health information to perform insurance functions, such as claims administration, claims management, and other insurance functions outlined in the regulation. The law provides an extensive and complete list of insurance functions for which disclosure is permitted, and further allows addition of additional insurance functions with the approval of the commissioner as long as they are necessary for the appropriate performance of the other insurance functions, and are fair and reasonable to the consumers.
