Counseling and testing — Insurance requirements

Insurance issuers that request current or prospective enrollees to provide the results of an HIV test must give the enrollee information that explains the HIV test, the risk factors for HIV, the reason for the HIV test, the risks of HIV testing, and the means of obtaining HIV counseling prior to the test.

These insurance issuers must then obtain the prospective enrollee’s informed consent. Such consent must be in writing, explain the confidentiality of the test, and identify procedures for informing patients that (1) they must obtain post-test counseling if they test positive or the test is inconclusive; (2) they may choose a post-testing counseling provider; and (3) they will not directly receive the results of a positive or inclusive test.
