“Disclosure of information under the health law”

Mental health information disclosed to a court pursuant to a court order must be kept confidential and must not be disclosed except if the individual identified consents in writing or upon court order. However, the medical information may be disclosed to a potential home care provider if the individual or the individual’s guardian provides written consent. A person who improperly discloses a person’s medical information may be fined up to $2,000, imprisoned up to a year, or both.
