Violations of the Medical Records Act of 1974

If a hospital or its personnel willfully, recklessly, or wantonly violate any of the provisions of the Medical Records Act of 1974 that governs access, confidentiality, storage, and destruction of patient records, they will be liable for actual damages in a civil action suit. They will receive any immunities or limitations to liability or damages that are available to them by law.
