“Disciplinary action; misconduct under the occupations and professions law”

The board of nursing may discipline a nurse for a variety of reasons including the following:

  • Unethical conduct;
  • The nurse’s failure or inability to perform nursing or nursing assistant practice with reasonable skill and safety;
  • Unprofessional conduct; and
  • Any nursing practice that may create unnecessary danger to a client's life, health, or safety.

Every individual or facility that employs licensed nurses must report to the board of nursing within 30 days any disciplinary action taken against a nurse. An individual or facility that fails to report may incur a $1,000 per violation.
