Requirements for Medical Information Exchange Centers – N.Y. Ins. Law § 321

When an insurance company that is authorized to transmit medical information in any manner requests medical information from any applicant for personal insurance, it may transmit that information to another facility if such if provides the applicant with a disclosure containing the following information:

• A description of the facility and its operations;
• The circumstances under which the facility may release such information;
• The applicant’s rights to request the facility disclose the nature and substance of the information; and
• The applicant’s rights to seek correction of any inaccuracies or incompleteness of such information.

No facility may release, transmit or otherwise communicate any medical information to any other person unless the person has a signed disclosure from the applicant specifically naming the facility and authorizing the person to obtain information from the facility.
