Courts have limited authority to order the disclosure of confidential HIV related information.  Courts may allow the disclosure of confidential HIV related information to peace officers, attorney general, or prosecutors if there is a compelling need for the disclosure, there is a clear and imminent danger from not disclosing to a person in contact with the HIV infected person, or there is a clear and imminent danger to the public health.  The person’s whose records are subject to disclosure and those holding the records must be given notice and be given an opportunity to respond to the request for disclosure.  Once the court makes a determination on whether the HIV related information may be disclosed, the order authorizing disclosure must be specific, limit disclosure to necessary persons, and include provisions to limit disclosure of the information.
