Requirements and Duties of Providers of Services to the Mentally Disabled – N.Y. Mental Hyg. Law § 31.11

Every provider of services to the mentally disabled must comply with the following requirements:

  • Notify the district attorney or other appropriate law enforcement official and the commissioner or his authorized representative as soon as possible if it appears that a crime has been committed against a patient receiving services from the provider;
  • Cooperate with the commissioner or his authorized representative and with the commission on quality of care for the mentally disabled or any authorized representative in any investigation or inspection; and
  • Permit the commissioner or his authorized representative and the commission on quality of care to inspect its facility and all books and records, including patient records.

 

Information obtained by the commissioner or the commission on quality of care for the mentally disabled from the records of patients receiving services will be kept confidential.
