A dispenser must maintain a prescription record for each prescription drug dispensed to a patient and must retain the records for no less than 5 years. All prescription records are confidential and must not be disclosed without patient approval. A dispenser may, however, disclose such information to the patient, the authorized prescriber, an agent of government responsible for enforcing drug and device laws, a person authorized by court order, and anyone engaged in research projects approved by the board.
A pharmacist may refill a copy of a prescription from another pharmacy so long as the statutory requirements are met. However, if pharmacies share a real-time, on-line database, they need not comply with Section 3.
