Designation of patient advocate; “community mental health services program or hospital” defined

 

A patient, who is over the age of 18, can designate another individual over the age of 18 to make his or her health treatment decisions. The patient advocate designation must be written, signed, dated, and witnessed and be part of the patient’s medical record and kept onsite. The witness must not be the patient’s spouse, parent, child, grandchild, sibling, or physician, and the witness must only sign the designation if the patient is of sound mind and under no duress. The designation must state that it is effective only when the patient is unable to make his or her own medical decisions.
