Violations; penalties

All state agencies, health professional licensing agencies or boards that collect, maintain or distribute health data must provide the Department of Health and Hospitals with all necessary data.  In addition, all health providers in the state, including hospitals, outpatient surgical  facilities, and outpatient clinical facilities must submit data to the Department.  Any person or entity that violates the laws under this section or any rules regarding patient confidentiality will be guilty of a misdemeanor and if convicted will be charged a fine between $500-$1,000, imprisonment for one month, or both.  Any person or entity knowingly violating the laws under this section or relevant rules will be guilty of a misdemeanor, and may be punishable by a fine of $1,000.  Renewal of state licenses issued by the Department or health professional licenses will be based on compliance with the reporting requirements.
