Health care providers must send all biological specimens taken for HIV detection to the department of health’s lab unless the testing occurs at a hospital lab or rapid HIV testing site.

Hospitals must report positive HIV test results to the department and all sites that perform HIV testing must submit an annual HIV testing report to the department.

The department will conduct all confirmatory HIV/AIDs testing except that rapid HIV testing sites may provide such testing by obtaining a waiver from the department. Rapid HIV testing sites that perform confirmatory testing must submit both positive and negative test results to the department.

Health care providers must include patient names and other identifying information (e.g. insurance information) when reporting test results or providing specimens to the department for HIV testing unless the test is anonymous.
