Kan. Stat. Ann. § 39-1411, Register of reports

Requires the Secretary for Aging and Disability Services to maintain a registry of reports regarding abuse, neglect, and exploitation of facility residents.  Authorizes access to the registry by Department for Aging and Disability personnel, Department of Health and Environment personnel, persons required by federal law, and persons otherwise designated by the Secretary. Requires the Secretary to furnish information regarding abuse, neglect, or exploitation perpetrated by a licensed provider to that provider's licensing agency. Authorizes licensing agencies to consider such information in a disciplinary hearing. Classifies reports, written findings, and recommended actions as confidential and not subject to Kansas’s open records act. Permits disclosure if persons named in the report request disclosure or give their written authorization for the disclosure. Permits use of the information in administrative or judicial actions if the judge or presiding officer determines that admitting the information outweighs the confidentiality concerns.
