Ind. Code Ann. § 16-39-4-2 - "Primary caregiver"; written request from relative or guardian for information; provision of mental health records to a school

This law allows a provider to give access to a patient’s mental health records to a patient’s spouse/parent/adult child/sibling/guardian who is involved in the provision and monitoring of mental health services to the patient upon the written consent of the physician.  The law further allows a provider to provide access to a child’s mental health record to a child’s school principal with the written request of the adult who is responsible for the provision and monitoring of mental health services to the child.  When such a parent or guardian makes a written request for the records, they are also required to sign any authorization allowing the release of the records required by the provider in accordance with federal and state law.  The law shields a provider who provides a child’s mental health records to a school principal under this law from civil or criminal liability.
