Ind. Code Ann.§ 16-36-1.5-5 - Consent to mental health services by mentally incompetent patient

This law states that a mentally incompetent patient who receives mental health services can provide informed consent in one of the following ways:

  • Through patient’s legal guardian or court appointed representative
  • Through the patient’s health care representative
  • Through an attorney in fact for health care
  • Through a health care representative appointed through a properly executed psychiatric advance directive
