Idaho Code Ann. § 39-609, Declaration of Policy

Declares that an effective program for the prevention of HIV/AIDS must protect the confidentiality of patient information and limit use of patient information to public health purposes. States that the Idaho legislature recognizes that certain persons may need to know a patient’s HIV status in order to protect themselves. Grants public health officials discretion to disclose information in order to prevent imminent danger to the health of the public. Identifies persons that may have a legitimate need for such information as including health care providers, lab technicians, and morticians.
