Idaho Code Ann. § 39-1392e, Limited Exceptions to Privilege and Confidentiality

Specifies the information that health care organizations must disclose to persons bringing a civil claim against health care provider or facility whom the organization has information about (e.g., whether the organization has investigated the provider or facility, the disposition of the investigation, when a disposition will be reached, etc.). Authorizes persons bringing a civil claim against a provider or facility to ask health care organizations for the names and addresses of persons that the organization knows to have knowledge related to the claim. Clarifies that the rules of discovery apply for matters already in litigation. Permits health care organizations to make these disclosures without a court order so long as the provider consents to the disclosure and the disclosure does not contain confidential information about other patients or providers.
