Florida Statutes § 458.327

“Penalty for violations under the regulation of professions and occupations law”

A physician is guilty of a felony of the third degree for the following:

  • The practice of medicine without a license;
  • Fraudulently obtaining a license to practice medicine; and
  • Improperly dispensing controlled substances. 

A physician is guilty of a misdemeanor of the first degree for referring a patient to a health care facility in which the physician or the physician’s employer has a financial stake without first notifying the patient of his financial interest.
