The department of job and family services and any contracting agency must protect the identity of nursing facility residents and any individual who submits a complaint about a nursing facility. The department may disclose this information as required by a court order, as necessary for the administration or enforcement of any statute relating nursing facilities, or with permission of the individual or his legal representative.
Any record that could or does identify an individual is not a public record and may not be disclosed unless otherwise authorized.
